These Terms of Use (“Terms”) govern your use of health365jobs.com and our related services (together, the “Service”), operated by Health365 Jobs (“Health365,” “we,” “us”). Please read them carefully.
1. Agreement to these Terms
By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. What Health365 is
Health365 is a search engine for healthcare job openings. We are not an employer, recruiter, or staffing agency, and we are not a party to any employment relationship or arrangement between you and an employer. We do not guarantee that you will receive an interview, an offer, or a job. Health365 is not a healthcare provider, and nothing on the Service is medical, legal, or career advice.
3. Job listings and third-party content
Job listings come from employers’ own websites and other third-party sources. Listings may be incomplete, out of date, or removed at any time, and we do not guarantee that any listing is accurate or still open. Please confirm the details with the employer before relying on them.
You apply on the employer’s own website, and that site’s terms and privacy policy govern what you submit there. Employer names, logos, and other marks belong to their owners, and their appearance on the Service does not mean the owner sponsors or endorses us. It is your responsibility, and the employer’s, to confirm licensure, credentials, and other job requirements.
4. Accounts
You can browse jobs without an account. To save jobs or use other account features, you must be at least 16 years old and provide accurate information. Keep your password confidential and tell us promptly if you think your account has been accessed without permission. You are responsible for activity under your account.
5. Acceptable use
You agree to use the Service only for lawful purposes. You may not disrupt it, attempt to gain unauthorized access to it, or use it in a way that harms Health365 or other users.
6. Your content
You keep ownership of information you provide, such as your account details and the jobs you save. You give us a limited license to store and use it as needed to operate and improve the Service, as described in our Privacy Policy. You are responsible for the information you provide.
7. Our intellectual property
The Service, including its design, text, software, and the way listings are organized and presented, belongs to Health365 or its licensors and is protected by law. We give you a limited, revocable, non-exclusive license to use the Service for your personal, non-commercial job search. Except as these Terms allow, you may not copy, modify, or distribute it.
8. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or secure, or that listings or other content will be accurate, complete, or current.
9. Limitation of liability
To the fullest extent the law allows, Health365 and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities, arising out of or related to your use of the Service or any job listing or employer. Our total liability for all claims relating to the Service will not exceed $100. Some places do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnity
You agree to defend and hold Health365 harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or the law.
11. Ending access
You may stop using the Service at any time and can ask us to delete your account. We may suspend or end your access, or change or discontinue any part of the Service, at any time, including if we believe you have violated these Terms. Sections that by their nature should survive will continue to apply.
12. Employers and other agreements
If you are an employer or hospital with a separate written agreement with us, that agreement also applies to your use of the paid features it covers. If it conflicts with these Terms, the separate agreement controls for those features.
13. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted here with its effective date. If you keep using the Service after a change takes effect, you accept the updated Terms.
14. Governing law
These Terms are governed by U.S. federal law and the laws of the State of Florida, without regard to conflict-of-law rules.
15. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver of it. You may not transfer your rights under these Terms without our consent, but we may transfer ours.
